The Promotion is open to all Trade Customers and Consumers resident in the Republic of Ireland and Northern Ireland, aged over 18 excluding employees and their immediate families of the Promoter or Distributors, their affiliated companies, their agents or any other persons professionally connected with the Promotion.
By entering the Promotion, all entrants will be deemed to have accepted and be bound by the rules. All entry instructions form part of the rules.
In order to enter the Promotion Trade Customers must first fully register as participants or Consumers must vote for one registered Trade Customer at www.natrionalburgerday.ie.
Trade Customer entry to the Promotion and eligibility to win the Trade Prize is strictly conditional on them offering all Consumers a “Buy One Burger, Get One Free” special burger deal for the duration of National Burger Day on Thursday 20th June 2019.
Entry is limited to one Registration per Trade Customer and one Vote per Consumer. No bulk, consumer group or third party entries will be accepted. Entrants cannot exchange money for votes.
Consumers must provide a valid email address when entering and this email address will be used to contact the winner. Multiple email address are forbidden and will result in disqualification and forfeiture of any Prize offered.
There is one Trade Customer Prize and one Consumer Prize available to be won. Each Prize consists of a trip for two people to Las Vegas, including scheduled return flights from Dublin, taxes & fuel surcharges, three nights, four-star (or equivalent) hotel accommodation, chosen at the discretion of the Promoter, with two people sharing per room, on a Room Only basis. Transfers, Insurance and all other costs are the winners responsibility.
Closing date for receipt of all votes is 12pm on Tuesday 18th June 2019.
Winners, once verified, will be published from Friday 21st June 2019 on the website, via Sponsor Partners and other media channels.
The Trade Customer Prize will be awarded to the Trade Customer with the most valid Consumer Votes received by the closing date. The Consumer Prize will be awarded to one Consumer chosen at random by an independent judge, from all valid entries received voting for the winning Trade Customer. Prize winners will be subject at all times to verification.
The Prize Trips are subject always to availability & booking and certain peak time travel dates are excluded. Prize winners will be required to be flexible with their travel dates and Prize trips.
Prize Trips will be subject to any additional terms and conditions of any supplier of the prize elements to the Promoter, e.g. airlines, hotels, travel agents etc.
Prize winners and their guests must be in possession of a full, current and valid passport must be eligible to travel to the prize destination listed and will be solely responsible for attaining any required visas or travel permits.
If, for any reason, the Promoter believes that false email accounts have been set up by any entrant in order to acquire more votes the Promoter reserves the right to disqualify this particular entrant from the Promotion.
Prize winners will be contacted by the email address provided. All reasonable effort will be made to contact each winner, however, if any prizes are not claimed within 1 week of initial contact the prize will be deemed to be forfeited and an alternative winner may be selected without notice.
Winners may be required to participate in publicity without further recompense. This may include the taking of photographs and film of the Winner(s) that will belong to and may be used in promotional material by the Promoter. Further, the Winner’s images and /or likeness may be used by Promoter for the purposes of promotional activity and activations on digital, printed and broadcast media platforms.
The Promoter shall not be liable for any loss, damage or consequential damage of any nature in contract, tort (including negligence) or otherwise caused by acceptance of the terms and conditions or in connection with any prize (except to the extent that death or any personal injury occurs as a result of the negligence of the Promoter).
The Promoter shall not be liable for any issues whatsoever with respect to any prize once dispatched to the winner and the Promoter accepts no responsibility in relation to the winners’ conduct or their guests’ conduct once the prize is claimed by the winner.
The prizes are as stated, they are non-transferable, non refundable and cannot be exchanged for any cash alternatives in whole or in part. The decisions of the Promoter are final and no correspondence will be entered into.
In the event that a prize cannot be sourced, or in the event of unforeseen circumstances the Promoter reserves the right to substitute the prize for an alternative of equal or greater value.
Incomplete entries or those not in accordance with the entry instructions will not be accepted and the Promoter reserves the right to remove, edit or disqualify any entry, at their sole discretion, if for any reason, it is believed to be incongruent with these terms and conditions.
The Promoter accepts no responsibility for any entries not received or for undelivered or delayed messages which were unable to be sent due to network coverage, technical failure or any other reason beyond its control. No responsibility will be accepted by the Promoter for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.
The Promoter does not warrant that any use of or access to the website will be uninterrupted by error or virus free nor will it have any liability for damage caused by hostile software which may infect an entrant’s equipment or property as a result of that participant using or browsing the website www.nationalburgerday.ie.
If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) is suspected or affects the fairness and/or integrity of this Promotion, we reserve the right to cancel, change or suspend this Promotion. This right is reserved whether the event is due to a human or technical error. If a solution cannot be found to restore the integrity of the Promotion, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Promotion.
Computer “hacking” is unlawful. If you attempt to compromise the integrity or the legitimate operation of this Promotion by hacking or by cheating or committing fraud in ANY way, we may seek damages from you to the fullest extent permitted by law.
Personal details that Entrant supplies during the application process will be processed by Kepak with appropriate confidentiality. Kepak may also keep records of any correspondence which it has with Entrants. Other than as stated at the point of collection, no personal details will be divulged to anyone or any organisation outside of Kepak, its data processors, Sponsor Partners, service providers or the Distributors. The entrant undertakes that, to the extent that they have supplied or supplies personal details, they have obtained the necessary consents to permit Kepak, its data processors, Sponsor Partners, service providers or the Distributors, to use their personal data for the purposes of the Promotion.
Kepak may use the personal details supplied for the following purposes: (i) to help manage and administer the Promotion and improve the way it is run; (ii) to help Kepak understand customer patterns; and (iii) where specific consent has been given, to provide a Trade Customer with relevant tailored offers by email, SMS, post or via a Kepak website.
Kepak may also use (and provide to Distributors) information relating to sets or groups of Trade Customers, including reports containing registration and aggregate voting data, to enhance its understanding of customers and enable Kepak and the Distributors to improve their service to Trade Customers.
Entrants can ‘opt out’ if they do not want to be contacted for some or all forms of direct marketing purposes from time to time (including by e-mail and SMS) with information about products, services and other related special offers.
These terms and conditions shall be governed by Irish law and the courts of the Republic of Ireland shall have exclusive jurisdiction.
